Terms & Conditions

These terms and conditions outline the agreement between Everbloom Rentals and its customers regarding the rental of floral arrangements and related items. By engaging in any rental transaction with Everbloom Rentals, you agree to abide by these Terms.

Reservation and Payment: Full payment is due at the time of reservation. Once you have agreed to our terms and conditions, and have paid the invoice in full, your reservation will be added to our rental calendar. Reservations are given on a first come, first served basis and dates may fill up quickly.

Cancellation and Refunds:  Cancellations made more than 90 days in advance of the scheduled reservation may be eligible for a partial refund, subject to Everbloom Rentals' discretion. The amount of the refund will depend on the time and resources Everbloom and its employees have spent on preparing for your event. This includes banking fees incurred for payment and refund processing, time spent forming your proposal and generating your invoice, coordinating with you, your florist, and event location, and other preparations. Cancellations made 90 days or less of the scheduled reservation will not be given a refund. Weddings are typically planned far in advance and late cancellations often prevent Everbloom from renting our florals to another party. We want to make sure everyone has an opportunity to rent our product. In the event of an emergency, natural disaster, government restriction, pandemic, or fire within 90 days of your event, we will reschedule your rentals for another date.

Rental Period: The rental period starts and ends on the date specified on the booking request. Any extension of the rental period must be approved by Everbloom Rentals in advance and will require additional fees.

Event Location: Please coordinate with your event location to ensure that our florals will fit in the available space. Refunds will not be given if the florals do not fit. 

​

Delivery and Pickup: Everbloom will deliver the rentals to the specified address on the agreed-upon date and time. Everbloom will also arrange for the pickup of rentals at the end of the rental period. You agree that the rentals will be ready for pickup at the agreed-upon time and location. Any changes to the drop-off or pickup schedule must be communicated to Everbloom Rentals in advance. All orders include delivery, setup, and pickup, with a pickup time of no later than 9:00 PM, and delivery within 25 miles of our warehouse location in Murray, UT. Pickups past 9:00 PM will incur an additional fee. The delivery cost for rentals outside of a 25 mile radius from our warehouse will be an additional fee of $1.50/mile each direction and not to exceed 60 miles. The extra delivery fee will be added to your invoice.    

 

Any pickups past 9:00 PM are subject to a late-night pickup fee, which can be found below:

Pickup After:

- 9:30 PM charge of $50

- 10:00 PM charge of $75

- 10:30 PM charge of $125

- 11:00 PM charge of $200

- 11:30 PM charge of $250

- 12:00 AM charge of $300

​

Any items that are unable to be returned will result in additional billing of a replacement fee of four times the rental price.  This will be due upon receipt.

 

Additional Fees for Setup and Movement: Rental price is for one delivery and setup location. Additional fees will apply if the items need to be moved from the ceremony to the reception or other location. Please coordinate with us during the booking process and we will include the additional fees on your invoice for transportation and set up at the second location. Our arches are very large and do not fit through standard doorways. This requires our movers to disassemble, remove, transport, and reassemble them at the new location. For insurance reasons we require our own team to move any items.

Product Handling and Responsibility: You agree to not handle or move the rentals.  Any damage, loss, or excessive wear beyond normal use will result in additional charges to replace the damaged items, as determined by Everbloom Rentals.

Rain or Wind Policy: No rentals can be left outside overnight. Rental items CANNOT be in the rain, snow, or heavy wind due to the permanent damage that will occur. If there is rain, snow or wind coming, and the rentals are outside, we will come get them early or move them to an indoor location. No one is allowed to transport, take-down, or move our product without prior written approval. If the rentals need to be moved inside due to inclement weather, no refunds will be given if the rentals do not fit or if your event is canceled or postponed.

Emergency Policy: In an emergency situation, due to the sudden onset of inclement weather, or other circumstances, that could cause damage to the rentals, please contact us and we will provide you with instructions and authorization to move the rentals indoors or to a safe protected location. Failure to notify Everbloom of the need to move the rentals, that results in damage to the product, will result in additional charges to replace the damaged items.

 

Additional Charges for Damage to Product: Damage to our product will result in additional charges of twice the cost of the rental price but may be adjusted higher depending on the severity of the damage. Water damage is permanent and will require a complete rebuild of the product and will result in additional charges of four times the rental price.

Use of Rentals: Rentals are intended for decorative purposes only and should not be altered, disassembled, or used for any other purpose without explicit permission from Everbloom Rentals.

Liability: Everbloom Rentals shall not be liable for any damages, injuries, or losses arising from the use or misuse of rentals, except in cases of negligence or willful misconduct on the part of Everbloom Rentals.  You agree to indemnify and hold Everbloom Rentals harmless from any claims, damages, or liabilities arising from your use of the rentals.  Everbloom Rentals shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of nature or government restrictions.

These Terms shall be governed by and construed in accordance with the laws of the state of Utah. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Salt Lake City, Utah.  Everbloom Rentals reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Everbloom Rentals website or other communication channels.

Venue and Location Limitations: Everbloom is limited by the rules and guidelines of the event location(s) and site management. Negotiation with the event location management for modification of their guidelines is the responsibility of The Customer. Everbloom Rentals will offer recommendations only. Reimbursements will not be made for unused items due to venue limitations not communicated to Everbloom Rentals.

Cancellation by Everbloom: Everbloom Rentals retains the right to terminate this contract if, at any point, it deems unable to fulfill its obligations. In such an event, Everbloom Rentals will reimburse the paid amount, as notified to you.  Any dispute or claim arising from or related to this contract, or its violation, will be resolved through arbitration. The arbitration proceedings will occur in Salt Lake City, Utah, presided over by a single arbitrator. The arbitrator's decision may be enforced in any court with jurisdiction.

 

By proceeding with the rental transaction, you confirm that you have comprehensively reviewed, understood, and consented to adhere to these Terms and Conditions.
